Order

10/09/2026

1. The present Special Appeal is directed against the order dated 02.08.2024, by which the learned Single Judge directed the State to consider the case of the respondent-employee for regularization of service in terms of the decision rendered by the learned Single Bench of this Court in the case of Nand Lal Gurjar [2026:RJ-JD:43598-DB] (2 of 2) [SAW-648/2025] v. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.

6318/1999).

2. Learned counsel for the appellants-State submit that the respondent-employee has not completed five years of service as on 01.05.1985 as per the scheme projected before Hon’ble Supreme Court in the decision dated 29.03.1995 passed in the case of State of Rajasthan v. Mod Singh (SLP (C) No.

21173/1994).

3. Learned counsel for the respondent-employee submits that the respondent-employee has rendered 42 years of service in accordance with law and he retired in 2023; therefore, he is entitled for grant of benefits in terms of the decision in the case of Nand Lal Gurjar (supra).

4. We have heard learned counsel for both the parties and have perused the material available on record.

5. This Court finds that the learned Single Judge has only directed the State to consider the case of the respondent- employee (petitioner therein) in light of the decision rendered in the case of Nand Lal Gurjar (supra) for consideration; as such, we do not find any merit in the present special appeal.

6. In the result, the present special appeal is dismissed.

7. Pending application(s), if any, shall stand disposed of.
