HON'BLE MR. JUSTICE FARJAND ALI

Order

05/11/2026

1. It is observed that, in matters where the investigation is conducted and the prosecution is carried out by Central Investigating Agencies, such as the Central Bureau of Investigation (CBI), Central Bureau of Narcotics (CBN), Narcotics Control Bureau (NCB) or any other Central Agency, the State of Rajasthan is unnecessarily impleaded as a party and copies of the petitions are routinely supplied to the learned Public Prosecutor representing the State, even though the prosecution is not being conducted by the State. Such an incorrect practice results in unnecessary impleadment of the State and avoidable procedural complications.

2. While dealing with matters falling within the present roster, this Court has noticed that such procedural irregularities are recurring. Accordingly, with a view to preventing such practice, the Registrar (Judicial) is directed to ensure that, in all matters arising out of prosecutions conducted by the CBI, CBN, NCB or any other Central Investigating Agency, the concerned investigating/prosecuting agency is duly impleaded as a party and copies of the petitions are supplied to its authorised representative. The State of Rajasthan shall not be impleaded as a party merely as a matter of routine, nor shall copies of the petitions be routinely supplied to the learned Public Prosecutor representing the State in such matters, unless the State is otherwise a necessary or proper party.

3. Accordingly, the Registrar (Judicial) is directed to ensure strict compliance with the aforesaid directions. All matters arising out of prosecutions conducted by the CBI, CBN, NCB or any other Central Investigating Agency shall be scrutinised at the filing stage, and such matters shall not be registered unless the concerned Central Agency is duly impleaded as a party. The practice of routinely impleading the State of Rajasthan and supplying copies of the petitions to the learned Public Prosecutor in such matters shall be discontinued.

4. In the present case, the investigation was conducted by the Central Bureau of Investigation (CBI), which is also carrying out the prosecution. Accordingly, Mr. P.C. Solanki, learned counsel appearing for the CBI, is directed to appear and represent the respondent in the matter.
