J U D G E M E N T

1. This application has been filed under Section 16 of Railway Claims Tribunal Act, 1987 read with 124-A of Railways Act, 1989 by the applicants i.e. husband and daughter of the deceased, Suchismita Bhattacharjee for compensation on account of death of the victim, who allegedly died in an untoward incident.

2. Brief history of the case of the applicant is that on 15.01.2019 the deceased left her residence at about 7.15 hrs to catch the local train from Sonarpur and her destination was Sealdah Station. At about 8.15 hrs she suddenly fell down from running UP train at Km Post No.11/4 to 11/06 between New Garia and Baghajatin Station. Immediately she was removed to M.R.Bangur Hospital and then shifted to Calcutta Medical College and Hospital where she expired on 17.01.2019 at about 7.00 hrs. The husband of the deceased had no knowledge about such an incident and therefore on 15.01.2019 he made a missing diary before the Sonarpur P.S. and on 29.01.2019 husband of the deceased came to Sonarpur P.S. and according to their suggestion he went to N.R.S. Hospital Morgue and saw the photograph of his wife and then identified the dead body.
