J U D G E M E N T

01. This claim application is filed by the applicants under Section 16 of the Railway Claims Tribunal Act, 1987 read with Section 124-A of the Railways Act, 1989 seeking compensation of Rs.8,00,000/- (Rupees Eight Lakhs only)

with interest from the Respondent Railway for the death of Bhola Poddar alias Podar (hereinafter referred to as “the deceased”) in an alleged untoward incident that occurred on 23.06.2022.

02. Brief facts of the case:

It has been pleaded in the claim application that on 23.6.2022 the deceased Bhola Poddar alias Podar left his house to travel from Madhupur to Baidyanathdham on his valid 2nd class monthly railway ticket bearing No.11709042 (valid from 05.6.22 to 04.7.22) and railway I.Card. On the same day he was returning home in the evening from Baidyanathdham to Madhupur by 63564 Jasidih-Asansol Memu Passenger Train on his valid ticket. During the journey he was standing near the gate and due to sudden jerk and jostling amongst the passengers, he fell down at Lalgarh DN line near Madhupur station and died on the spot. Original railway ticket was handed over to the wife of the deceased which the officer got from the pant pocket of the deceased.
