2. &ief focs of me cqse: According to the originol cloim opplicotion on 20/1O/2023 Roniit Ekko (herein ofter referred to os rhe deceosed) olong wirh four others of neorby villogers nomely A.K. potro, B. Kerketto, s. Tirkey ond s. Bilungo purchosed o ioint reservotion troin iourney ticket ot Bolugoon roilwoy stotion to trovel to Villupurom by Troin No. 20896 (Bhuboneswor-Romesworom Superfost troin). They boorded the soid troin from Berhompur roilwoy stotion. During course of iourney, on 2l/lo/2023 ot obout 3:16 AM, he (deceosed) occidentolly fell down from the running troin ot KM No. 3Ol /27-29 in between Ammonborolu & Korvodi roilwoy stotions of Andhro Prodesh Stote, sustoined iniury ond died on the spot. The body of the deceosed wos first noticed by the on duty Key Mon lying beside the roilwoy trock. He immediotely informed the motter to on duty SM (Stotion Moster) of Korovodi roilwoy stotion. ln this connection the Govt. Roilwoy Police, (GRp), ongle, hos registered o crime cose beoring No. 106/2023 ond took up investigotion. lt is overred by the Appliconts thot the deceosed wos o bono fide possenger ond on the dote of incident, he wos trovelling on the strength of one ioint reservotion iourney ticket beoring pNR No. 6526937735 dqted 20/10/2023 from Bolugoon ro Villupurom roilwoy stotion with boording ot Berhompur roilwoy stotion.

Respondent's Reply: On receipt of the notice, the Respondent Roilwoy filed its written stotement to the cloim opplicotion olong with DRM's stotutory investigotion report (Ext.l). ln the written reply, it is stoted thot the deod body of the deceosed wos first noticed by on-duty Key Mon; the body wos lying beside UP line trock ot KM No. 301 /27-29 in between Ammonborolu & Korvodi roilwoy stotions lt is odmitted thot os per stotutory inquiry report the deceosed wos trovelling olong with four (4) others with o volid iourney ticket (woitlisted) beoring PNR No. 6526937735 doted 20.10.2023. According to the DRM's investigotion report there is no eye witness to the olleged occidentol foll ond hove concluded thot the deoth of the deceosed is suspicious in noture ond might hove been coused on occount of reosons other thon occidentol foll from troin, for OA ^(llu) 92 of 2024 Page 3 which it wos cloimed thot the Respondent Roilwoy Administrotion wos not responsible ond the cloim opplicotion should to be dismissed.
