1. This Claim Application is filed by the Applicants u/s. 16 of the Railway Claims Tribunal Act, 1987 read with Sec. 123 (c) (2) & Sec. 124 - A of the Railways Act, 1989 for compensation arising out of an alleged untoward incident occurred on 12.08.2017 involving death of Sarvesh Kumar s/o Rajbahadur. The Applicant claims that she is the mother of Sarvesh Kumar s/o Rajbahadur and is only dependent of the deceased.

The factual matrix of the matter in nut-shell is as below:

2. It is stated in the Claim Application that Sarvesh Kumar s/o Rajbahadur (hereinafter referred as deceased) was a resident of Taluka: Handiya, Dist: Allahabad, U.P. and was engaged in service. It is stated that on 12.08.2017, the deceased was travelling from Karjat to Koparkhairane Railway Station in a train. At about 07.05 hrs, when the said train was traversing in between Bhivpuri and Neral, there was a sudden push from other passengers in the compartment due to which the deceased accidentally fell down from the running train, sustained injuries and died before admission in the hospital .The Applicants have further claimed that the deceased was allegedly travelling on the strength of a Second class Railway Ticket between Karjat to Kopar Khairane Railway Station valid on the day of the incident which was lost in the incident.Therefore, the deceased was a bonafide passenger at the time of the incident.

3. In response to notice, Respondent Railway appeared and opposed the Claim Application. The Respondent filed Written Statement and also produced on record the DRM report pertaining to investigation conducted by IPF/RPF/Karjat, accompanied with other relevant police papers marked as “R-1”. Following has been contended in the DRM’s Report:
