01. This claim application (0.A) has been filed by the applicants under Section 16 of the Railway Claims Tribuna! Act, 1987 read with Section 123 (c) (2) and 124-A of the Railways Act , 1989 seeking compensation with interest from the respondent railway for the death of Binay Das (hereinafter referred to as "the deceased") in an alleged untoward incident, occurred on 09.05.2023.
02. Brief facts of the case:- As per original claim application (0.A.), the deceased Binay Das, a labourer, while traveling from Sahebganj to Ghogha fell down from the running train accidentally on 09.05.2023 near Tetraia Basti and died on the spot due to injuries sustained. It is alleged that the second class journey ticket from Sahebganj to Ghogha was lost in the alleged incident. The applicants are the wife, two daughters and mother of the deceased.
