JUDGEMENT

1. This Claim Application is filed by the applicants under Section 16 of the Railway Claims Tribunal Act, 1987 read with Section 123 (c) (2) & Section 124 - A of the Railways Act, 1989 for compensation arising out of an alleged untoward incident occurred on 22/23.08.2018 involving death of Tejas S/o. Sunil Surve, (herein after referred as the deceased). The Applicants claim that, being parents of the deceased, they are the dependents of Tejas S/o. Sunil Surve.

The factual matrix of the matter in nut-shell is as below:

2. It is stated that, the deceased, Tejas S/o. Sunil Surve, resident of Ratnagiri, was unmarried and working in Godrej Company. It is alleged that, on 22.08.2018, the victim Tejas purchased Railway ticket near about 23:30 hours to travel from Diva to Badlapur Railway Station. Later he boarded a local train and started his journey to travel from Diva towards Badlapur Railway Station. On the intervening night of 22.08.2018 and 23.08.2018, when the said train was traversing in between Diva and Kopar Railway station, due to sudden jerk of the train his right leg got entangled and came under the wheels and the deceased accidentally fell down from the said train and sustained injuries. He was taken to Shastri Nagar Hospital, Dombivali and later was shifted to Sion Hospital for better medical treatment, wherein, he was declared dead on 23.08.2018. The Applicants have further stated that the deceased was holding a valid 2nd class Railway Ticket bearing No. UFB 26399276 dated 22.08.2018 and the true copy is filed alongwith Original Application. Recovery of the same is mentioned in the Inquest Panchnama. It is therefore contended that the deceased was a bona-fide passenger and died in an untoward incident occurred on 22/23.08.2018.

3. In response to notice, Respondent – Railway Authority appeared and opposed the claim application. The respondent filed Written Statement and also produced on record the DRM’s report pertaining to investigation conducted by IPF/RPF/Diva, accompanied with other relevant police papers marked as “R-1”.

It has been contented in the DRM Report that:
