The Railways Act is beneficial legislation requiring liberal interpretation. The absence of a travel ticket does not automatically negate a claim for compensation if the claimant discharges the initial burden of proving bonafide travel through an affidavit.

Headnote:The claimants sought compensation under Section 125 of the Railways Act, 1989, and the Railway Claims Tribunal Act, 1987, following an untoward incident where the deceased fell from train number 54790 between Chomu and Ralot. The Railway administration contested the claim, asserting that the deceased was not a bonafide passenger and that no negligence on the part of the railways was established. The court framed issues regarding whether the deceased was a bonafide passenger as per Section 2(29), whether the incident constituted an 'untoward incident' under Section 123(c)(2) read with Section 124A, and the dependency of the applicants under Section 123(b). The court reasoned that while the initial burden of proving bonafide travel lies with the claimant, it can be discharged via affidavit; the absence of a ticket is not conclusive evidence against the claim. Relying on the principle that the Railways Act is beneficial legislation, the court held that a liberal interpretation should be adopted to serve the statute's purpose. This case is decided in favor of the applicants, awarding compensation of Rs. 8,00,000 with 9% annual interest from the date of the incident.
