1. The present bail application under Section 439 of the Code of Criminal Procedure (hereinafter referred to as ‘the Code’) has been filed by the applicant, who is in custody in connection with the FIR No.357/2023 registered at Police Station Subhashnagar, Bhilwara for the offences punishable under Sections 147, 149 and 302/34 of the Indian Penal Code and Section 4/25 of the Arms Act.
2. Mr. Chundawat, learned counsel for the applicant submitted that the co-accused namely, Abhishek @ Abhimanyu has been enlarged on bail by this Court vide order dated 19.03.2024 in S.B. (2 of 4) [CRLMB-3583/2024]
3. Mr. Bhati, learned Public Prosecutor opposed the bail application.
4. Mr. Menaria, learned counsel appearing for the complainant is not in a position to dispute the aforesaid position of facts and law.
5. Heard learned counsel for the parties and perused the material available on record.
6. While allowing the bail application (SBCRLMB No.944/2024) of the co-accused – Abhishek @ Abhimanyu, this Court has observed thus:-
