1. Learned counsel for the appellant submits that admittedly the Insurance Policy in question is an ‘Act Only Policy’ and it is also admitted on record that the deceased was a passenger in the private car and could not have been termed to be a ‘third party’.

• the judgment passed by the Hon’ble Apex Court in the case of Anu Bhanvara & Ors. vs. IFFCO Tokio General Insurance Company Limited & Ors.; AIR 2019 SC 3934 which pertains to a ‘Goods Carrying Vehicle’. The principle and the ratio as laid down wherein the deceased could not be held to be a ‘third party’.
