O R D E R

1. The present transfer petition has been filed seeking transfer of Domestic Violence Complaint (DVC) bearing DVC No. 71 of 2023 titled as “A.S. Ravia Begum V. M. Nizamuddin & Ors.” pending before the Judicial Magistrate, 1^st Class, Nellore District, Andhra Pradesh. In order to explore the possibility of the dispute being amicably settled, this Court referred the matter to Supreme Court Mediation Centre. The report received from the Mediation Centre would indicate that the parties have resolved their disputes as per the terms set out in the settlement agreement dated 03.01.2025 placed on record. The terms as agreed to between the parties read as under:

there will be no relationship as wife and husband. The parties have following litigation pending: -

1. FCOP No. 197 of 2023 on the file of Hon'ble Judge Family Court Cum VI Additional District and Sessions Judge at Nellore, Andhra Pradesh.

2. DVC No. 71 of 2023 on the file of the Hon'ble Additional Judicial Magistrate of First Class at Nellore, Andhra Pradesh.

(II) That the First Party has floated certain companies in which the Second Party Mrs. Ravia Begum was also a inactive partner of a small share of 5%. The said companies are now no more operational for the last 5 years. The First Party undertakes that he will take all responsibility existing and otherwise with regard to those company regarding any financial/otherwise liability or litigation. The Second Party will have no responsibility in any manner whatsoever. She also undertakes to transfer her shares in the Company in the name of First Party on or after the sale of Property detailed in para III (d) below.

(III) It has also been agreed that (a) Flat No 301, Varsha Prime Apartments, Vishwas Nagar Colony, Madeenagauda Village, Seriligampallay Mandal and Municipality, Ranga Reddy District - 500049. This flat is already registered in the name of Second Party and shall continue.

(b) One half share in Plot No. 103, admeasuring 215.95 Sq. Yards, in Survey Nos. 20,21,22 & 33/P, situated at Mehdi Garden, Shamshabad Village and Gram Panchayat Shamshabad Mandal R.R. District covered by Ward and Block No. 6. The other half share belong to First Party which he has sold to third party. The First Party assures all help and cooperation to demarcate and identify her share.

(c) One constructed villa situated in plot No. 2 admeasuring 200 Sq Yards in Survey No. 57E, 58, 59, 60/E/A, 61/E/AA, 71/AAA, 72, 74/U, 74, 75/AA, 76/AA, 77, 79, 81 by A and 82/ AA situated at Shambupur Village, Bowrampet, Gram-Panchayat, Quthbullapur Mandal, Medchal- Malkajgiri District Telengana. Both parties are having equal shares in the above said property. The parties have further agreed to sell this property to third party and the Second Party has taken an initiative to dispose off the said property at a mutually agreed highest price within a period of six month which can be extended mutually upto one year. The respective Advocates of both sides are kind enough to forsee and monitor the sale.

(d) One flat No. 506, Fifth Floor, Municipal No. 8-3- 833/ A/4 to 7106 Dwarakamai, Krishna Block, Survey Nos. 74. & 93, Navodaya Colony, Yellareddyguda, Hyderabad, Telengana, which is in possession of First Party. This Flat is in the name of Second Party, the Second Party undertakes to relinquish it and execute the relinquishment/ release deed/ gift deed in favor of First Party. The same shall be done at earliest and not later than sale of prope1iy detailed in para (c).

(e) All the cases detailed in para (I) filed by either of the party shall be disposed off/ settled in terms of this Settlement. Any of the party will not have any claim against each other.

(f) All parties undertake to follow the terms of this settlement. Any violation of this undertaking would amount to a
