O R D E R

1. Heard learned counsel for the parties.

2. During the pendency of this Transfer Petition, the parties have entered into a settlement which is annexed along with Interlocutory Application No.2792 of 2025. The terms of the settlement are extracted below:

“Terms of Settlement”

1. Both parties agree, in consultation with their respective family members, to end the existing dispute amicably. They will live separately while maintaining dignity and respect for each other and their families.

2. The Respondent will hand over the Petitioner’s ornaments and other belongings as per the list prepared on 24.08.2024. Since the belongings are at the Respondent’s house, he will deliver them to Mr. Rishi Matoliya in Delhi, who will then transport them to Sikar.

3. The Respondent will pay a total sum of Rs.30 Lacs (Rupees Thirty lacs) to the petitioner as expenses, Stridhan, and alimony via bank draft.

4. Both the parties will file a joint petition for divorce before the Hon’ble Supreme Court, seeking a decree of divorce under Section 13B of the Hindu Marriage Act. 5. Both the parties would also pray before the Supreme Court to dispose of/quash the following cases Signature Not Verifipedending between the parties:-

titled as Himanshu Vs. Apurva pending before the court of Principal Judge, Family Court, Rohini Court, Delhi.

B. Restitution of Conjugal Rights Petition-

Application No.697/2023 titled as Apurva Vs. Himanshu pending before the court of Family Court No.3, Jaipur.

6. After the payment is made and the belongings are handed over, neither party will have any further claims against the other for any additional money or items.

7. The parties would also request the Learned Mediator of the Supreme Court Mediation Centre to complete the necessary formalities and refer the case to the Hon’ble Supreme Court for further adjudication. The advocates for bother parties will assist the Learned Mediator and the Hon’ble Supreme Court in this regard.”

3. In terms of the Settlement Agreement, a prayer has been made to dissolve the marriage by invoking the powers under Article 142 of the Constitution of India, 1950.

4. Having regard to the settlement between the parties, this Transfer Petition is disposed of in terms of the settlement extracted above. We also invoke our jurisdiction under Article 142 of the Constitution and dissolve the marriage in terms of the settlement. Let a decree of divorce be drawn in terms of the aforesaid settlement.

5. In addition to above, the cases mentioned in paragraph 5 of the Settlement Agreement, as extracted above, shall be treated as withdrawn/quashed.

6. The Transfer Petition is disposed of, as above.
