The Court determined that multiple FIRs across states cannot be clubbed in a single Writ Petition but suggested seeking relief from respective High Courts.

O R D E R

We have heard learned counsel for the petitioners and learned ASG/senior counsel and learned counsel for the respondent No.1 and respondent-State(s). We have perused the material on record.

The petitioners have sought the following reliefs:

“A. Issue a Writ of Mandamus or such other appropriate Writ directing the transfer and/or clubbing of all FIRs i.e. FIR No.03/2024 registered in Nagaur, Rajasthan, FIR No.50/2024 registered in Delhi, FIR No.23/2024 registered in Mumbai, Maharashtra registered against the Petitioners to be brought together before any appropriate Investigating Agency/Court in the State of Delhi as deemed fit by this Hon’ble Court.

B. Issue appropriate directions for the enlargement of the petitioners on bail by passing appropriate directions till the disposal of the regular bail application by the court competent to take cognizance of the clubbed/transferred FIRs mentioned as below:

i. Delhi, FIR No.50/24 u/s 419/420/120B IPC & 66C, Signature Not Verified

66D IT Act, PS Chief Judicial Magistrate, Patiala Digitally signed by RADHA SHARMA House Court, New Delhi Spl. Cell, New Delhi dated Date: 2025.01.24 Reason: 16.02.2024.

ii. Rajasthan, FIR No.03/2024 u/s 406/420/120B IPC and 66C, 66D IT Act, PS cyber Nagaur Rajasthan dated 23.01.2024 iii. Maharashtra, FIR No.0034/24 u/s 420/467/468/471 IPC 66C and 66D IT Act PS Navi Mumbai Cyber Police Station, East region, Cyber Police Station Maharashtra Production warrant issued iv. Maharashtra, FIR No.0045/24 u/s 420/467/468/471 IPC and 66C, 66D IT Act PS Pune City Cyber police station Pune City Production warrant issued.

v. Maharashtra, FIR No.23/24 u/s 420/467/468/471 IPC and 66C, 66D IT Act PS Greater Mumbai cyber police Station North Production warrant issued.

vi. Maharashtra PS Cyber Cell HQ, Pune city, Pune FIR No.0099/24 u/s 420/467/468/471 IPC & 66C and

66D IT Act vii Crime PS South CEN FIR No.0117/24 u/s 419/420/467/468/471/PC and 66 C and 66 d IT Act Bengaluru City viii. Police Station Cyber Nagpur City FIR No.- 005/24 u/s 419/420/465/468/471/IPC and 66 C and 66 d IT Act.

C. Issue a writ of mandamus to the effect that no cognizance or any complaint would be taken by any Court nor any FIR registered by the police on the cause of action in the present Writ Petition.”

We find that FIRs as against the petitioners herein are filed in different respondent-State (s). In the circumstances, we do not think that the reliefs sought for by the petitioners herein could be granted.

However, it is observed that if within the State(s) there are multiple FIRs filed against the petitioners herein, they could seek relief before the jurisdictional High Court(s) for clubbing of the FIRs.

The Writ Petition is hence, dismissed.

Pending application(s), if any, shall stand disposed of.
