Mr. Indrajit Mahanty, learned senior counsel for the petitioner argues that in the earlier round of litigation the learned counsel for petitioner has withdrawn the special leave Signature Not Verified Digitaplly seignted biytion though it has been filed on the same facts and against the Jagdish Kumar Date: 2024.08.09

same order, but the material difference is that the first petition was dismissed as withdrawn. The order dated 03.05.2024 passed in SLP (Crl.) No.3998/2024 titled “Sheela Devi Vs. State Of Haryana”
is as follows:-
“1.Learned counsel for the petitioner, at the outset, seeks permission to withdraw the present Special Leave Petition.
2.Permission as sought for is granted.
3.The Special Leave Petition is, accordingly, dismissed as withdrawn.”
This has been done without any liberty to file another petition. Moreover, in the first round of litigation, the petition was dismissed as withdrawn by another Court. Therefore, in our mind this matter should go to the same Court, since the learned counsel has now argued that he did seek the liberty to file another petition.
Registry may place the records to file the matter before the Hon’ble Chief Justice of Ind
