SUPREME COURT OF INDIA
SHAURABH KUMAR TRIPATHI – Appellant
Versus
SHAURABH KUMAR TRIPATHI – Respondent
ORDER
Leave granted. Heard the learned senior counsel appearing for the appellant and the learned counsel appearing for the respondent-State and the learned counsel appearing for the respondent No.2. In a petition filed by the appellant for quashing the proceedings of a criminal trial, the High Court entertained the petition, but declined to grant stay. The High Court did not fix the case for hearing within a reasonable time. While passing the impugned order of rejecting the prayer for stay, the High Court simply adjourned the case to enable the respondent No.2 to file a reply. The High Court did not even fix a date for hearing. Hence, we set aside the impugned order of the High Court to the extent to which the application for stay was dismissed.
