ORDER
The matter was posted for orders in respect of Suitors’ Fund amount for which none of the parties have moved any application for withdrawal. Rule 7 of Order XXIV of the Supreme Court Rules , 2013 provides that if the appeal is allowed by the Court, the amount deposited by the appellant would be refunded to him without interest but if it is dismissed, the same will be allowed to be withdrawn by the respondent or may be disbursed as per the direction of the Court in that behalf. Since Civil Appeal No. 799 of 2017 was neither allowed nor dismissed but was disposed of, none of the parties have moved any application for withdrawal of the Suitors’ Fund amount. In such a situation, the amount can be disbursed as per the direction of the Court, as provided under Rule 7 mentioned above. In the final order passed by this Court in Civil Appeal No. 799 of 2017, the respondents were granted some relief for final settlement of the matter.
