This appeal challenges the order dated 09.05.2024 passed by the High Court of Madhya Pradesh, Jabalpur in MCRC No.17669/2024. The appellant herein has been booked for the crime registered pursuant to FIR/Crime No.57/2023 dated 29.01.2023 registered at Police Station City Kotwali, District Satna (M.P.) for commission of offence punishable under Sections 363 , 366(A), 506, 376(3), 376(2)(n) of the Indian Penal Code , 1860 (for short “IPC”) and Sections 5L/6 , 5(J)(ii) of the Protection of Children from Sexual Offences Act , 2012(POCSO).
The appellant preferred the third bail application under Section 439 of the Code of Criminal Procedure , 1973 (“the Code” for short).
Appellant’s first and second bail applications were dismissed as withdrawn and not pressed by order dated 17.02.2024 and 10.04.2024 respectively in the High Court. By order dated 09.05.2024, the High Court has rejected third bail application filed by the appellant for grant of regular bail. Hence, this appeal. This Court vide its order dated 10.06.2024, issued notice in the instant appeal.
We have heard learned counsel in support of the appellant and learned counsel for the respondent-State.
