IN THE SUPREME COURT OF INDIA CIVIL ORIGINAL JURISDICTION RAVINDER KAUR Petitioner(s)

VERSUS SHAMSHER SINGH Respondent(s)

O R D E R

The petitioner (wife) has filed this transfer petition seeking transfer of RCS HM NO. 0000099 of 2023 titled as Shamsher Singh v. Ravinder Kaur filed by the respondent (husband) pending in the Court of I Additional District Judge, Dabra, District Gwalior, to the Court of equivalent jurisdiction at District Court, Amrtisar, Punjab.

Vide order dated 13.12.2023 passed by this Court, the parties were referred for mediation before the Supreme Court Mediation Centre to mediate the issues and for settlement. As Signature Not Verified Digitally signed by Nidhi Ahuja per the report dated 16.02.2024 received from the Supreme Date: 2024.04.29

17:55:37 IST Reason:

Court Mediation Centre, mediation remained unsuccessful.

Having heard learned counsel for the parties and considering the averments made in the transfer petition, in our view, it would be inconvenient to the petitioner(wife) to attend the proceedings at Dabra, Madhya Pradesh, which is at a distance of about 900 kilometers from Amritsar, Punjab, where she is currently staying with her parents, and therefore, we deem it appropriate to allow this transfer petition.

Accordingly, RCS HM NO. 0000099 of 2023 titled as Shamsher Singh v. Ravinder Kaur filed by the respondent (husband) pending in the Court of I Additional District Judge, Dabra, District Gwalior, is ordered to be transferred to the Court of District Judge, Amrtisar, Punjab, who may deal with the case himself or assign the same to a Court of competent jurisdiction at Amritsar, Punjab.

Needless to observe that the transferee Court may allow the presence of the respondent-husband on virtual platform without insisting for his presence on every date until required necessarily.

Let the records of the case be transferred to the transferee Court without delay and an intimation be sent to both the Courts through e-mail for compliance.

The transfer petition is, accordingly, allowed.

Pending application(s), if any, shall stand disposed of.
