1. By way of this petition filed under Section 25 CPC, the petitioner - wife seeks transfer of the Original Suit No. 538 of 2024 titled “Abhishek Kumar Sinha vs Shilpi Sinha” filed by the respondent – husband under Section 9 of the Hindu Marriage act, 1955 seeking restitution of conjugal rights, pending before the Court of Principal Judge, Family Court, Dhanbad, Jharkhand to the Court of competent jurisdiction at Chandigarh, Union Territory.
2. The respondent-husband, although served with the notice issued by this Court yet has chosen not to remain present before this Court either in-person or through an advocate.
3. Sufficient cause having been made out by the petitioner – wife, warranting transfer of the case, as prayed for by her, the Transfer Petition deserves to be allowed. It is ordered accordingly.
