UPON hearing the counsel the Court made the following

O R D E R

Having heard the learned senior counsel for the

petitioner as also the learned counsel for the respondent-

UOI, we take note that this Court while directing notice to

the respondents on 06.07.2023, had taken into consideration

all aspects of the matter and had granted interim

protection against arrest of the petitioner herein.

Though, the learned counsel for the respondent would

contend that the petitioner, taking advantage of the said

order dated 06.07.2023, is not participating in the further

process before the Trial Court, we make it clear that if

the petitioner herein, does not diligently participate in

the further process before the Trial Court, it would be

open for the respondent to bring this aspect of the matter

to the notice of the Trial Court, and the Trial Court may

take appropriate action in that regard.

In terms of the above, the interim protection against

arrest, granted by this Court on 06.07.2023 is extended

until completion of the process subject to the petitioner

diligently participating in the further process.

The petition is accordingly, disposed of along with the

pending application(s), if any.
