UPON hearing the counsel the Court made the following

O R D E R

Learned counsel for parties are ad idem that the parties are

agreeable to the following aspects:

1.

A mutual consent divorce.

Adequate provision for maintenance of the child.

3.

A sale of the property, which is joint, which

would take care of the maintenance.

The only impediment seems to be is the issue of permanent

custody of the child. The mother seeks to keep the permanent

custody with her but visiting rights for the father whereas the

father wants joint custody of the child for the time being and

further arrangement can be worked out later depending on how the

situation arises after a few years. The grievance of the father is

also that even the interim arrangement for visiting rights are not

being worked out.

We direct as under:-

(a)

The mother shall ensure compliance of interim

arrangement for visiting rights to the father in

terms of the existing interim arrangement ordered

by the Court below.

(b)

The parties will remain present on the next date

of hearing.

List in the miscellaneous week after ensuing winter recess,

2022.
