O R D E R

Leave granted.

1. Appellants lay challenge to the order dated 26-09-2024 in CRLP No. 6200/2022 and 6201/2022 titled “M/s. SRT Constructions Pvt.Ltd & Arn. Vs. The State of Telangana & Anr.” passed by the High Court for The State of Telangana at Hyderabad.

2. We are happy to record that during the course of the process of mediation, the parties have amicably resolved their disputes. The Settlement Agreement dated 26.03.2025 is taken on record.

3. We appreciate the efforts put in by the learned Signature Not VerifiedMediator Shri Gaurav Yadava as also the respective counsel Digitally signed by RAJNI MUKHI Date: 2025.05.05

17:28:33 IST appearing for the parties.

Reason:

4. The terms of the Settlement Agreement dated 26.03.2025 shall form part of the order.

5. The relevant portion of the Settlement Agreement is extracted as under:

“The First Party shall pay an amount of Rs. 1,00,00,000/- (Rupees One Crore Only) to the Second Party on or before 21 May 2015 by way of a Demand Draft drawn in favor of the Second Party. This amount is towards full and final settlement of all claims that arise out of the Lease Deed dated 28-08-2017 and agreement dated 05-09-2017 between the parties and also the proceedings bearing STC. NI. No. 738 of 2021 pending before the X Metropolitan Magistrate, Hyderabad arising out of dishonor of Cheque no. 002802 dated 23-01.2020.

2. Both parties hereby withdraw all the allegations made against each other in their respective legal notices and in the proceedings before the Hon'ble High Court and before the Hon'ble Supreme Court of India.

3. Both parties hereby undertake not to initiate any fresh civil or criminal proceedings or raise any fresh monetary claims against each other in relation to the Lease Deed dated 28-08-2017, agreement dated 05-09. 2017 and dishonor of Cheque no. 002802 dated 23-01-

2020, on any future date.

4. The Second Party hereby agrees to unconditionally withdraw STC. NI. No. 738 of 2021 before the X Metropolitan Magistrate, Hyderabad upon receipt of Rs.

1,00,00,000/- (Rupees One Crore only).

5. The parties undertake to abide by the terms and conditions set out in the above mentioned Settlement Agreement, which have been arrived with free will of the parties without any coercion, duress or collusion and parties undertake not to raise any dispute whatsoever henceforth.

6. That by signing this Agreement the parties hereto solemnly state and affirm that they have no further claims or demands against each other including claims on any movable or immovable property and all the disputes and differences have been amicably settled by the parties hereto through the process of mediation.”

6. Parties undertake to abide by the same. Parties through their learned counsel present in the Court, have been made aware of the consequences of breach of the Terms of Settlement Agreement.

7. The appeals are disposed of in the above terms. The order dated 26-09-2024 in CRLP No. 6200/2022 and 6201/2022 titled “M/s. SRT Constructions Pvt.Ltd & Arn. Vs. The State of Telangana & Anr.” passed by the High Court for the State of Telangana at Hyderabad is set aside.

8. Pending application(s), if any, shall stand disposed of.
