18:04:30 IST 1) Arising out of the notice of demolition issued by the Reason:
Executive Engineer, South East, Road I, PWD, New Delhi, the present petition has been filed. Previously also, SLP (C)D. No.21645 of 2025 was filed which was withdrawn with liberty to raise all the objections before the High Court.
2) In the first round, when the matter was taken up, we have requested the office of Additional Solicitor General and the counsel for the NCT of Delhi to remain present. As such, they are present.
3) During hearing, it is informed by the learned counsel for the parties that in W.P. (C)No. 8035 of 2024 titled as Shabnam Burney v. Union of India and Ors., an application has been filed seeking stay on demolition. As the matter is of Special Bench, therefore, on request, the case is fixed for hearing on such application today which may likely to come up at 3 o’clock.
4) Learned counsel for the petitioner submits that until the effective hearing and orders passed on the question of interim relief, the demolition which may likely to take place tomorrow, 10.05.2025, as per notice may be stayed.
5) After hearing learned counsel for the parties, we find that notice on demolition has been issued which is under challenge in this petition. Similar relief has also been prayed before Delhi High Court by filing an application in the pending writ petition. Since the case has been fixed today for hearing, therefore, at present, we postpone the hearing till 13.05.2025.
6) In the facts, we request the Delhi High Court to grant effective hearing on the application wherein the prayer seeking stay on demolition has been made and to pass an order, if possible today.
7) In case, the order has not been passed by the High Court; in the said contingency, we direct that demolition as per notice may not be carried out till next date before this Court.
8) It is clarified that we have not expressed any opinion on the merits of the case or on the issue of grant of interim relief. Our order is transitional and subject to order of the Delhi High Court.
9) In case Delhi High Court is of the opinion that no interim relief can be granted, in that contingency, our order shall not be given effect to.
10) List on 13.05.2025.
