IN THE SUPREME COURT OF INDIA CIVIL ORIGINAL JURISDICTION TRANSFER PETITION (CIVIL) NO. 2267 OF 2024 SHIVANGNI JAIN PETITIONER VERSUS LALIT CHAUHAN RESPONDENT

O R D E R

1. This transfer petition under Section 25 of the Civil Procedure Code, 1908, is at the instance of the petitioner-

wife.

2. During the pendency of this petition, the parties were referred to the Supreme Court Mediation Centre for the purpose of exploring the possibility of an amicable settlement.

3. Today, learned counsel appearing for the parties jointly submitted that the parties have been able to arrive at an amicable settlement and Interlocutory Application No. 111874 of 2025 has been jointly filed seeking dissolution of marriage by mutual consent.

4. The petitioner-wife and the respondent-husband are Signature Not Verified personally present in the Court Room today.

The terms and conditions of the settlement have been reduced into writing and duly signed by the parties, Mediator and their respective lawyers. The original Settlement Agreement dated 04.04.2025 is annexed with Interlocutory Application No. 111874 of 2025, which is ordered to be taken on record. The terms of the settlement reads thus:

“SETTLEMENT AGREEMENT This Settlement Agreement is entered into between Petitioner- Ms. Shivangni Jain W/o Mr. Lalit Chauhan D/o Anil Kumar Jain, R/o. A1-203, 2^ND Floor, Edenn Tower, Shankar Kalat Nagar, Wakad Pune, Maharashtra – 411057 and also at H. No. 15, 2^ND Floor, Singhal Residency Near Gurudwara, Nav Vihar Colony, Hamdiya Road, Bhopal Madhya Pradesh (here in after referred to as Petitioner-Wife) and Mr. Lalit Chauhan S/o Kamlendra Kumar Singh R/o 66/30, Jagner Road, Sri Nagar, Naripura Agra, Uttar Pradesh – 282001 (here in after referred to as Respondent-husband).

1. Whereas the marriage between the petitioner and respondent husband was solemnized as per Hindu rites and ceremonies on 19.05.2018 at Agra, Uttar Pradesh. After marriage parties resided together at Ghaziabad, Uttar Pradesh and there is no issue out of this wedlock.

2. Both the parties resided together as husband and wife till March 2020, and thereafter disputes and differences arose between the parties and since then she is staying separately at Pune, Maharashtra. The Petitioner wife filed Divorce Petition no. RCS HM 1210/2022 before the Ld. Additional Principle Judge Family Court at Bhopal, Madhya Pradesh seeking dissolution of marriage.

3. Whereas the Parties have filed following cases against each other:-

(i) The Petitioner wife has filed Divorce Petition no. RCS HM 1210/2022 before the Ld. Additional Principle Judge Family Court at Bhopal, Madhya Pradesh Shivangni Jain Vs Lalit Chauhan.

(ii) The Respondent husband has filed Section 9 Restitution of Marriage before Additional Principle Judge Family Court Agra bearing no. HMA 2717/2022 titled as Lalit Chauhan Vs Shivangni Jain and the next date of hearing is 17.05.2025.

4. Whereas Hon’ble Supreme Court vide Order dated 20.01.2025 in Transfer Petition (C) No. 2267/2024 has referred the matter to Supreme Court Mediation Centre. Comprehensive mediation sessions were held between the parties and their respective advocates on 14.02.2025, 27.02.2025, 05.03.2025, 19.03.2025, 29.03.2025 (physical and virtual both ) and today i.e. 04.04.2025 (physically for signing of the present Settlement Agreement).

5. Both the parties hereto have arrived at an amicable settlement on the following terms and conditions for dissolution of marriage by mutual consent:-

A. That the parties have agreed that the Petitioner- wife will pay to the Respondent-Husband a total sum of Rs. 3,00,000/- (Rupees Three Lakhs Only) towards full and final settlement for medical help of Respondent husband.
