SUPREME COURT OF INDIA
RAM KHILADI MEENA VS. THE SUPERINTENDANT OF POLICE KURUKSHETRA
T.P.(Crl.) No. 697/2024
IN THE SUPREME COURT OF INDIA CRIMINAL ORIGINAL JURISDICTION TRANSFER PETITION (CRIMINAL) NO.697/2024 RAM KHILADI MEENA PETITIONER(S)
VERSUS THE SUPERINTENDANT OF POLICE, KURUKSHETRA & ORS. RESPONDENT(S)
O R D E R
1. The petitioner prays for transfer of Case No.942/2021 titled “Ram Khiladi Meena vs. The Superintendent of Police, Kurukshetra & Ors.” from the Court of the Additional Sessions Judge, Kurukshetra, Haryana to the Court of the Sessions Judge at Dausa, State of Rajasthan.
2. This petition has been preferred invoking Section 406 of the Code of Criminal Procedure, 1973. The petitioner claims to be father of the deceased. The only ground urged for transfer is that if the petitioner goes to Kurukshetra his life may be in danger.
3. If the petitioner is to be examined as one of the witnesses in the trial, referred to above, then he may be examined online. He need not physically visit the Court at Kurukshetra, if otherwise his presence is not required.
CHANDRESH Date: 2025.05.09 Reason:
4. We are of the view that transferring the entire criminal case from Harayana to Rajasthan will be too much.
5. With a view to balance the equities, let the petitioner give his oral evidence if at all required online.
6. With the aforesaid, this petition stands disposed of.
7. Pending application(s), if any, stands disposed of.
