O R D E R
Mr. Gopal Sankaranarayanan, learned Court Commissioner, has handed over a Report, which is taken on record.
In the order dated 08.04.2025, in the last line, the words ‘Archaeological Survey of India’ shall be read as ‘Department of Archeology, Govt. of NCT of Delhi’. Rest of the order shall remain as it is.
The Municipal Corporation of Delhi has not vacated their office, as directed by this Court vide order dated 08.04.2025. Before we proceed any further we direct MCD to hand over the possession of the entire space, as mentioned at Page No. 8 in I.A.No. 110092 of 2025, to Land and Development Officer (L&DO), Ministry of Housing and Urban Affairs, by tomorrow i.e. by 15.05.2025, which in turn, shall hand over the same to the Department of Archeology, Govt. of NCT of Delhi, for the purposes for which this petition has been instituted i.e. to carry on the work we had indicated in our earlier orders.
As directed earlier, an amount of Rs. 40 Lakhs has been deposited by the Defence Colony Welfare Association with the Department of Archeology.
The small tiled wall which blocks the view of the Heritage Building from the main entry point shall be removed by the Department of Archeology, Government of NCT of Delhi forthwith. The Status Report(s) filed by the L&DO and MCD shall also be examined on the next date of hearing.
Re-list the matter on 16.05.2025 (after the normal work of both the courts is over).
