2. By the impugned order, though the learned Single Judge of the High Court has permitted personal affidavit of the Additional Commissioner Grade-2 (Appeal)-5 State Tax, Kanpur (Appellant No.2) to be filed, the Court has also directed the Principal Secretary, Institutional Finance, Government of Uttar Pradesh and the Appellant No.2 to remain present in person on the subsequent date fixed.

4. In that view of the matter, we set aside paragraph 8 of the impugned order.

6. The appeal is, accordingly, disposed of.
