We are inclined to allow the present appeals and condone the delay in filing the application for recall of the order dated 29^th October, 2015 in Writ Petition No.553 of 1997. In our considered view, the High Court ought to have itself condoned the delay which in any event, was neither deliberate nor inordinate. Since the applications for substitution, condonation of delay in filing substitution application, setting aside the abatement and condonation of delay in filing the application for setting aside abatement are not pressed at this stage, the same are withdrawn by the parties, reserving liberty to initiate appropriate proceedings before appropriate forum, in accordance with law.
