1. Learned counsel appearing on behalf of Respondent No. 1 has pressed IA No. 98347 of 2022 whereby direction to disburse the final amount due to Respondent No. 1 was prayed for with a further prayer to pass such other order as the Court may deem Signature Not Verified Digitally signfed biyt.

2. Indeed, it is correct that in a proceeding dated 31.07.2023, without prejudice to the rights and contentions of the parties, the Trial Court was directed to quantify the amount in terms of the order passed by the High Court.
3. After hearing learned counsel for the parties and on perusal of the record, it is quite vivid that the suit was filed seeking partition, separate possession and mesne profit wherein the Trial Court passed the judgment and decree on 29.10.2011. By the said judgment suit was partly decreed with an observation that there shall be a separate enquiry with respect to mesne profit. On filing appeals by the respective parties, the High Court allowed plaintiff’s appeal being RFA No. 158 of 2012 and appeals filed by Respondent Nos. 4 to 7 being RFA No. 216 o
