Learned counsel for the respondent submitted that in view of a petition being filed before the Family Court at Bhubaneswar(Odisha) jointly by both the parties seeking divorce by mutual consent under Section 13B(1) of the Hindu Marriage Act, 1955, the respondent does not wish to press Petition No.A- 199/2024 also filed for divorce under Section 13(1)(ia) and 13(1)(ib) of the Hindu Marriage Act, 1955 pending before the Family Court at Thane (Maharashtra).

In the circumstances, she submitted that this Transfer Petition may be, accordingly, disposed.

During the course of submissions, a copy of the petition dated 25.11.2024 filed before the Family Court at Bhubaneswar is also submitted before this Court.

In the circumstances, she submitted that permission may be granted to withdraw the petition filed by the husband herein before the Family Court at Thane.

Learned counsel for the petitioner submitted that if the Signature Not Verifiredespondent withdraws the aforesaid petition pending before the Digitally signed by RADHA SHARMA Date: 2025.01.16

10:50:45 IST Family Court at Thane, this Transfer Petition may accordingly, Reason:

be disposed of.

(C) NO.1853/2024 Recording the aforesaid submissions and having regard to the fact that the parties have filed a petition for dissolution of their marriage by mutual consent before the Family Court at Bhubaneswar and the submissions of learned counsel for the respondent that the respondent would ultimately withdraw the petition filed by the respondent before the Family Court at Thane, we do not think that this Transfer Petition would require further consideration.

Recording the aforesaid submissions, this Transfer petition stands disposed of.

Pending application(s), if any, shall stand disposed of.
