Leave granted.

By the impugned judgment, the application seeking condonation of delay of 866 days in filing the appeal under Section 101 of the Juvenile Justice (Care and Protection of Children) Act, 2015, filed by the appellant was rejected by the High Court.

It is not in dispute that the appellant seeks to raise the plea of juvenility. The law is quite settled that the plea of juvenility can be raised at any stage. If that is the position, the question of limitation will not arise.

Considering the above, we are inclined to set aside the impugned judgment.

Accordingly, the impugned judgment is set aside Signature Not Verified and the matter is remitted to the High Court for Digitally signed by ASHA SUNDRIYAL Date: 2025.01.16

17:04:49 IST fresh consideration.

Reason:

However, we make it clear that we are not going into the merits of the case, including the effect of the earlier proceedings.

The appeal stands allowed accordingly.
