O R D E R
1. Leave granted.
2. Appellant/landlord has challenged the judgment and order dated 20.12.2024 passed by the High Court of Judicature at Bombay in Civil Revision Application No. 753 of 2023 titled “Dilip Jasaramji Mali vs. Ramesh Ganesh Saxena ” whereby the Revision Application filed by the respondent/tenant stood allowed.
3. Having heard learned counsel for the parties, we are of the considered view that the High Court erred in reversing the concurrent findings of fact returned by the Trial Court as affirmed by the lower Appellate Court.
4. We have perused the issues framed by the Trial Court. The Trial Court vide judgment dated 20th April, 2023 found the Signaturer Noet Vesrifipedondent herein (tenant) to have persistently defaulted in Digitally signed by RAJNI MUKHI Date: 2025.08.01
18:23:27 tISThe payment of the rent prior to the institution of the Reason:
petition as also during the pendency of the proceedings. Such findings of fact stood affirmed by the lower Appellate Court in terms of judgment dated 02nd November, 2023.
