O R D E R

2. What we have been able to gather is that a suit for specific performance of agreement came to be instituted. The suit came to be partly allowed. The trial court directed the defendants to refund the earnest money with interest whereas declined to grant the relief of specific performance. The matter went in first appeal before the High Court. The High Court allowed the appeal and has decreed the suit.

4. There is one another development in the matter. The client of Mr. Vikas Singh is a subsequent purchaser. However, that should not be a problem. The efforts made so far to put to an end to the entire dispute have not yielded any positive result.

6. We appoint Hon’ble Mr. Justice A.S. Bopanna, former Judge of this Court to act as a Mediator between the parties.
