UPON hearing the counsel the Court made the following

O R D E R

Heard Mr.F.S.Nariman, learned senior counsel for the petitioner and Mr.P.S.Patwalia, learned senior counsel for respondent No.1. Having heard learned counsel for the parties we are only inclined to direct that the process for black listing the petitioner shall be finalized within eight weeks without taking into consideration the observation made by the High Court against the petitioner in the impugned order. In the course of hearing it has been apprised that a show cause notice has already been issued to the petitioner on 16.05.2016 and the matter is fixed for further hearing on 17.01.2017.

Mr.Nariman, learned senor counsel would submit after obtaining instructions that the petitioner has not yet been served the notice. Let a copy of the show cause notice be served upon Mr.Subhash Sharma, learned counsel who is assisting Mr.Nariman. Needless to say if the petitioner wants to raise any point relating to the issue of any violation of principle of natural justice before the competent authority liberty is granted to do so. The direction passed on 23.11.2016 by this Court shall continue to remain in force till the next date of hearing. The concerned authorities of respondent No.1 who are personally present today need not remain present on the next date of hearing.
