Court finds a case for transfer, leading to the allowance of the petition. RESULT: The Transfer Petition is allowed.

2. The present petition has been filed by the petitioners seeking transfer of Petition filed under Section 12 of the Protection of Women from Domestic Violence Act, 2005 bearing Comp D.V. Act/3/2024 titled as ‘Krishna Devi vs. Smt. Payal & Ors.’ pending before the Court of Judicial Magistrate First Class, Indora, District Kangra, Himachal Pradesh to the Court of Judicial Magistrate First Class, Amritsar, Punjab.

3. After hearing the learned counsel appearing for the petitioners, in our opinion, a case is made out for transfer of the case as there are two more cases between the parties pending at Amritsar, Signature Not Verified Punjab.

4. Accordingly, Petition bearing Comp D.V. Act 3 of 2024 titled as ‘Krishna Devi vs. Smt. Payal & Ors.’ pending before the Court of Judicial Magistrate First Class, Indora, District Kangra, Himachal Pradesh is transferred to the Court of Chief Judicial Magistrate, Amritsar, Punjab, who may either keep the matter in his Court or assign the same to any other Court of competent jurisdiction.

5. Records shall be sent by the Court where proceedings are pending to the transferee Court promptly.

6. In case video conference facilities are available in the transferee Court, the parties may be permitted to appear through video conference on non-effective dates of hearing.

7. The Transfer Petition is, accordingly, allowed.
