Reason:

a) Since no order prejudicial to the interest of the respondent(s) is being passed, the requirement of notice to the respondent(s) is waived.

b) These petitions arise out of an order passed by the learned Single Judge of the High Court of Judicature at Allahabad, vide which it has been observed that by the next date of the listing of the Contempt Petition, Respondent No. 3 (present petitioner) should either file compliance affidavit or place the final order in special appeal preferred by the State.

c) Ms. Ruchira Goel, learned standing counsel for the State of Uttar Pradesh, states that though various attempts have been made by the petitioner herein for moving the Division Bench to consider the application filed on behalf of the State of Uttar Pradesh for stay of the order passed by the learned Single Judge of the High Court but on account of the huge pendency, the application filed by the State of Uttar Pradesh is not being considered by the Division Bench of the High Court.

d) As it is not in the hands of the petitioner herein to get the matter before the Division Bench listed and taken up, we are, therefore, of the considered view that the contempt proceedings be deferred till the application filed by the State for stay of the order passed by the learned Single Judge is decided either way.

e) We also request the learned Division Bench of the High Court of Judicature at Allahabad to consider the application for stay filed by the State in accordance with law, on its own merit, as expeditiously as possible and preferably within a period of three months from today.

f) As already observed hereinabove, till the application for stay of the order passed by the learned Single Judge is decided either way, the contempt proceedings shall remain deferred.

g) The special leave petitions are, accordingly, disposed of.
