IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION Criminal Appeal No. 8 of 2026 @SLP (Crl) No. 17778/2025 SHAHIL SAIDAHMAD SUMRA Appellant(s)

VERSUS THE STATE OF GUJARAT & ANR. Respondent(s)

O R D E R

1. Leave granted.

2. We have heard learned counsel for the parties.

3. This appeal impugns an order dated 15.09.2025 passed by the High Court of Gujarat at Ahmedabad rejecting the Anticipatory Bail prayer of the appellant in connection with FIR No.I-06/2018 registered at Police Station Chhota Udepur, District Chhota Udepur. 4. After considering the submissions of learned counsel for the petitioner, on 17.11.2025 following order was passed:

1. The submission of the learned Counsel for the petitioner is that as per the prosecution case, the police party was attacked by the mob. It is the case of the petitioner that no injury was suffered by the police party particularly at the behest of the petitioner and there is also a cross version of the incident wherein the allegations are regarding police atrocities qua a pregnant lady. Further, as the charging Section 3(2) (v) of the Scheduled Castes and Scheduled Tribe (Prevention of Atrocities) Act, 1989 has been quashed, there is no legal embargo on consideration of anticipatory bail prayer.

2. Matter requires consideration.

3. Issue notice, returnable in six weeks.

4. In the meantime, it is provided that in the event the Digitaly signed by KANCHAN CHOUHAN Date: 2026.01.08 Petitioner is arrested in connection with FIR No. 6/2018

Reason:

5. Upon service of notice, the State is represented.

6. Learned counsel for the respondent-State admits that the appellant has cooperated in the investigation.

7. In such circumstances, we do not find any good reason to discharge the interim protection granted earlier. Accordingly, the appeal is disposed of by making the interim order absolute subject to the following two conditions:

(a) The appellant shall co-operate in the investigation and make himself available for interrogation as and when required by the investigating agency; and (b) He shall submit bail bonds, within a period of three weeks from today, to the satisfaction of the Trial Court concerned along with an undertaking that he shall not threaten the witnesses or tamper the evidence.
