O R D E R

This is a petition filed under Section 25 of the Code of Civil Procedure, 1908 (for short “CPC”). The petitioner is the wife of the respondent.

The petitioner has filed this transfer petition seeking the following reliefs:

“a. allow the instant Transfer Petition and thus transfer the Mat Suit No.33 of 2023 titled as “Sri P. Chandra Rao @ P. Chandra Sekhar Rao vs. Smt. P. Kamala pending before the Court of Ld. District Judge, Midnapur, Paschim Medinipur, West Bengal to the Ld. Principal Judge, Family Court, Berhampur, Odisha.

b. Pass any other order or direction as this Hon’ble Court may deem fit and proper in the facts and circumstances of the case and in the interest of justice.”

On perusal of the office report, it is noted that notice issued on 17.10.2025 was served on the respondent on 03.11.2025. However, there is no appearance on behalf of the respondent either through counsel or in person. Having heard learned counsel for the petitioner and on perusal of the material on record, we find that the petitioner has made out a case for transfer of the aforesaid petition.

In the result, the transfer petition is allowed and Mat. Suit No.33 of 2023 pending before the Court of District Judge, Midnapur, Paschim Medinipur, West Bengal is ordered to be transferred to the Principal Judge, Family Court, Berhampur, Odisha.

Registry to communicate this order to the transferor as well as the transferee courts for taking steps in accordance with this order.
