1. By way of this petition filed under Section 25 CPC, the petitioner - wife seeks transfer of the Family Main Case No.206/2024 titled “Ankit Kasera vs Megha Patel” filed by the Respondent – husband under Section 9 of the Hindu Marriage Act, 1955 seeking restitution of conjugal rights, pending before the Court of Principal Judge, Family Court, Jhalawar, Rajasthan to the Principal Judge, Family Court, Indore at Madhya Pradesh.
2. The respondent-husband, although served with the notice issued by this Court yet has chosen not to remain present before this Court either in-person or through an advocate.
3. Sufficient cause having been made out by the petitioner – wife, warranting transfer of the case, as prayed for by her, the Transfer Petition deserves to be allowed. It is ordered accordingly.
