UPON hearing the counsel the Court made the following
O R D E R
1. In compliance of the directions laid down by this Court in its judgment dated 28.05.2025, the parties have filed their respective affidavits.
2. In the petitioner’s affidavit, it is pointed out that 185 acres of land was required to be offered by Delhi Development Authority (DDA) for plantation and 1,67,000 trees were to be planted. However, as per the Expert’s report, there may be a demand for additional land over and above 185 acres for the purpose of the above-mentioned plantation.
3. The Department of Forest as well as DDA in their respective affidavits submit that 18 separate sites totaling 185 acres have been decided to be allocated to the Forest Department for the purpose of the aforementioned plantation. Out of these, physical possession of 17 sites, totaling approximately 168 acres, has already been handed over.
4. As regards the 18th site in Satbari, it is pointed out that there is a dispute re: ownership of the same between DDA and the Revenue Department. Mr. Maninder Singh, learned Senior Counsel for DDA, on instruction, informs that the issue has been resolved and that the 18th site will also be handed over forthwith to the Forest Department. In any case, we make it clear that even if the dispute subsists, the Revenue Department as well as DDA are directed to handover unconditional possession of the 18th site to the Forest Department.
5. Consequently, we direct that the Forest Department, under the supervision and guidance of the Expert Committee, will start the plantation drive(s), keeping in view suitable
