5. In the facts and circumstances of the case, we do not deem it necessary to exercise our discretionary jurisdiction under Article 136 of the Constitution of India so as to revive the matter which is dead for 33 years.

6. The petitioner may contest the suit on merits.

7. Accordingly, the Special Leave Petition is dismissed.

8. Pending applications, if any, shall stand disposed of.
