SUPREME COURT OF INDIA
Vijay Bishnoi, J
Carminia Dias Mandoly – Appellant
Versus
Public Information Officer – Respondent
MISCELLANEOUS APPLICATION Diary No(s). 1272/2025

The court exercises discretion in permitting the withdrawal of petitions and maintains strict procedural oversight by imposing definitive timelines for the rectification of filing defects to ensure the efficient progression of judicial matters.

Headnote:(A) Practice and Procedure - In-chamber proceedings - Withdrawal of petitions - Permission granted by Court - Certain matters dismissed as withdrawn.

(B) Practice and Procedure - Filing defects - Duty of Registry - Direction issued to verify the curing of defects in specific petitions.

(C) Practice and Procedure - Limitation - Curing of defects - Six weeks' time granted to rectify filing defects, failing which the matters shall stand dismissed without further reference to the Court.

Facts of the case:
Numerous miscellaneous applications and petitions were filed before the Court. For a group of matters, the petitioners sought permission to withdraw, which was allowed. Regarding another set of matters, counsel submitted that filing defects previously identified by the Registry had been rectified; the Court directed the Registry to verify this claim. For the remaining matters, the Court granted a period of six weeks for the parties to satisfy all procedural requirements.

Findings of Court:
The Court exercised its authority to permit the withdrawal of the requested matters. In matters where defects were claimed to be cured, the Court delegated the verification to the administrative level. A final opportunity with a six-week deadline was imposed for pending matters upon pain of dismissal.

Issues: The court addressed the procedural propriety of allowing withdrawals and the enforcement of deadlines for the rectification of administrative filing defects.

Ratio Decidendi: The Court may, at its discretion, permit the withdrawal of proceedings and establishes mandatory timeframes for the correction of filing defects to ensure the timely and orderly administration of judicial processes.

Result: Certain petitions dismissed as withdrawn; Registry directed to verify cured defects in specific matters; six weeks granted to cure defects in remaining matters subject to peremptory dismissal.
