SUPREME COURT OF INDIA
Vijay Bishnoi, J
Carminia Dias Mandoly – Appellant
Versus
Public Information Officer – Respondent
MISCELLANEOUS APPLICATION Diary No(s). 1272/2025

The court exercises its discretion to permit the withdrawal of proceedings by parties and mandates strict adherence to procedural requirements, granting a fixed timeframe for curing filing defects under threat of automatic dismissal to ensure administrative efficiency.

Headnote:(A) Practice and Procedure - Withdrawal of Petitions - Inherent powers of Court - Counsel for petitioners sought permission to withdraw numerous matters, including those deemed not maintainable - Permission granted and matters dismissed as withdrawn.

(B) Practice and Procedure - Filing Defects - Mandatory compliance - Registry directed to verify the curing of previously identified defects in certain matters, while six weeks’ time is granted for all remaining matters to cure defects, failing which they shall stand dismissed without further reference to the Court.

Facts of the case:
Numerous matters were placed before the Court in chambers. In some instances, counsel for the petitioners requested the withdrawal of the petitions, including one acknowledged as not maintainable. In others, it was submitted that identified filing defects had been rectified, necessitating verification by the judicial registry. A significant number of remaining matters contained various procedural defects.

Findings of Court:
The Court granted the requests for withdrawal and dismissed those specific matters. Regarding matters where defects were purportedly cured, the registry was mandated to verify compliance. For all other pending matters, a peremptory deadline of six weeks was imposed to rectify defects, failing which the matters are to be dismissed automatically without further judicial intervention.

Issues: The main issues addressed were the permissibility of withdrawing petitions at the request of counsel and the necessity of establishing strict procedural timelines for curing filing defects to manage judicial efficiency.

Ratio Decidendi: The Court affirmed that it retains the discretion to permit the withdrawal of legal proceedings at the behest of the petitioner and possesses the authority to issue peremptory orders to ensure the timely resolution of procedural defects, thereby maintaining the integrity and workflow of the judicial system.

Result: Certain matters dismissed as withdrawn; directions issued for the verification and rectification of procedural defects in remaining cases.
