VERSUS Y & ORS. RESPONDENT(S)

O R D E R

1. The respondent No.1/husband has filed an application seeking dissolution of marriage between the Petitioner No.1/wife and Respondent No.1/husband on the ground of irretrievable breakdown of marriage. The parties have arrived at a settlement by way of Settlement Agreement dated 21.07.2025 and they seek quashing of the entire litigation between the parties.

2. The petitioner No.1 and respondent No.1 were married on 22.04.2003. However, it appears that soon after the marriage the relationship between the parties became sour and they started residing separately from May, 2024.

3. It is not in dispute that the parties are living separately from 16th May, 2024.

4. Various matrimonial proceedings are pending between the Signature Not Verified Digitally signed by parties and it is clear that their marriage has reached a Date: 2025.09.04 Reason:

stage where it has become irretrievable. The parties have, therefore, decided to put an end to all the pending litigation between them.

No.1/husband are personally present in the Court and they reiterate about the settlement. A demand draft for a sum of Rs.60 Lakhs has already been handed over by the respondent no.1/husband to petitioner no.1/wife.

6. We find that this is a fit case wherein this Court should exercise its jurisdiction under Article 142 of the Constitution of India and put an end to their relationship as husband and wife so that they can start their life afresh.

Ordered accordingly.

7. In that view of the matter, I.A. No.199305/2025 is allowed in terms of prayer clauses (a) and (b).

8. The transfer petition is, accordingly, disposed of.

9. The Registry of this Court to draw a decree accordingly.
