Petition for Special Leave to Appeal (Crl.) No.1722/2026
ORDER
1. The Petitioner challenges the judgment and order dated 13.01.2026 passed by the High Court of Judicature for Rajasthan at Jodhpur in S.B.Criminal Writ Petition No.3607 of 2025 whereby the writ petition was dismissed and temporary release of the petitioner was denied.
2. The petitioner had surrendered on 23.09.2025.
3. We have perused the affidavit dated 31.01.2026 filed by the State. In principle State has no objection to the grant of interim bail for the reason that petitioner’s wife has to undergo surgery and there is none else in the family of the petitioner to attend to her. More so, when there is an eleven years old child born through the wedlock. Under these attending facts and circumstances, we allow the prayer of the petitioner in the following terms :
(A) The terms and conditions, as the State has referred to in paragraph 5 of its affidavit, shall be strictly adhered to.
(B) The petitioner shall be released on interim bail for a period of 45 days in connection with FIR No.42/2024 dated 12.03.2024 registered at Police Station Rohinda, District Sirohi; FIR No. 05/2024 dated 13.02.2024 registered at P.S. SOG, District- ATS/SOG-Jaipur; and FIR No.308/2020 dated 16.11.2020 registered at P.S. Raipur, District-Pali; and FIR No.335/2012 dated 28.09.2012 registered at P.S. Chandaria-District-Chittorgarh subject to the satisfaction of the concerned Superintendent of Jail.
(C) To comply with the order, the petitioner shall be produced before the concerned Superintendent of Jail forthwith.
(D) Immediately after expiry of 45 days from the date of release, the petitioner shall surrender before the concerned Court.
(E) We clarify that the liberty is granted to the petitioner only for the purposes of the treatment of his wife, who has to undergo surgery on account of her personal ailment.
(F) The petitioner shall file an affidavit before this Court to the effect that he shall comply with the terms and conditions.
4. The Special Leave Petition is disposed of.
5. Pending application(s), if any, shall also stand disposed of.
