Court's authority to order transfer of petitions under Code of Civil Procedure.

ORDER

1. The petitioner-wife has filed the petition under Section 25 of the Code of Civil Procedure , 1908 before this Court seeking transfer of Case bearing Petition No. 06 of 2024 titled as “Vivek Singh Vs. Saumya Singh” pending in the Family Court at Mau, Uttar Pradesh to the Family Court at Kashipur, Udham Singh Nagar, Uttarakhand.

2. Office Report dated 04.02.2026 indicates that service on the sole respondent is complete through the Trial Court, but no one has entered appearance on his behalf.

3. Having heard learned counsel appearing for the petitioners and taking into consideration the grounds taken in the transfer petition, we allow the transfer petition and direct the transfer of case bearing Petition No. 06 of 2024 titled as “Vivek Singh Vs. Saumya Singh” from the Family Court at Mau, Uttar Pradesh to the Family Court at Kashipur, Udham Singh Nagar, Uttarakhand.

4. Let the record of the case be transferred without delay.

5. A copy of this order be sent to the concerned court for compliance.

6. If video conferencing facility is available with the transferee Court, the benefit of the same shall be extended to the parties.

7. Pending application(s), if any, shall stand disposed of.
