ORDER
Ms. Amiy Shukla, learned counsel, states that she contacted respondent No. 2, Sharda Devi, but was unable to secure instructions as to whether respondent No. 2 would be agreeable to the proposal made by the petitioner, Manish Jogi, that he would ensure cancellation of the sale deed executed in his favour upon refund of the monies paid by him. Needless to state, in case such a proposal is accepted, the petitioner would also have to bear the stamp duties and registration expenses for the execution as well as the cancellation of the sale deed in question.
As Ms. Amiy Shukla, learned counsel, is unable to secure instructions in this regard, we permit the petitioner, Manish Jogi, to be released on interim bail for a period of one month on appropriate terms and conditions to be fixed by the trial Court, to enable him to contact respondent No. 2, Sharda Devi, and her husband, who are stated to be related to him, so as to persuade them to agree to his proposal.
The petitioner, Manish Jogi, shall also file an undertaking before the trial Court to the effect that he would surrender within one month from the date of his release. This undertaking shall also indicate in clear terms the willi
