UPON hearing the counsel the Court made the following

O R D E R

A request is made on behalf of the learned Solicitor

General, while accepting that there has been delay, that one more

opportunity after the last opportunity granted on the last date

should be given. On the Court’s query we are told that four weeks’

time may be given to file a comprehensive counter affidavit. In

order to ensure compliance, we make it clear that if it is not

filed within four weeks then it will be taken on record after four

weeks with a costs of Rs.25,000/-. The Attorney General is also

granted four weeks’ time to submit his note.

It appears that other then State of Uttar Pradesh and State of

Karnataka the other states have also not filed affidavits.

On similar terms last opportunity is given to the States also

to file their affidavits within four weeks. The failure to file an

affidavit within the specified time (whether filed or not) will

result in costs of Rs.25,000/- each.

Learned senior counsel for petitioner submits that he will

analyze the affidavits of all the States and prepare a chart.

List on 14^th February, 2023.
