Savita v. Satyabhan Dixit
1. Present Special Leave Petition has been filed challenging the impugned judgment and order dated 15th September, 2025 passed by the High Court of Judicature at Allahabad whereby the High Court on the basis of concession / statement made by learned counsel for the petitioner set aside the order of the First Appellate Court and granted temporary injunction.
2. Learned counsel for the petitioner states that the statement / concession made by the petitioner / defendant's counsel was wholly unauthorised and contrary to her instructions.
3. This Court has repeatedly held that the High Courts in India are the Courts of record and what is recorded in the Courts are correct and cannot be contradicted by the counsel for the parties (see State of Maharashtra v. Ramdas Shrinivas Nayak & Anr., (1982) 2 SCC 463.
4. Consequently, the present Special Leave Petition is disposed of with liberty to the petitioner to file an appropriate application before the High Court.
5. Pending application shall also stand disposed of.
